FedEx is trying to prevent the claiment from putting in a little time repairing the instrument and then selling it. In essence, they are making him back up his claim by relinquishing the instrument. If I where a shipper and knew nothing of how hard/easy it was to repair an instrument, I'd require the same thing.

Michael's claim was completely vaid and I'm glad he will be compensated. FedEx should have looked at his claim, said "Of course" and settled. However, I suspect that FedEx has to deal with fraudulant claims all the time and has developed a "deny first and see how hard they push back" attitude. It's a shame that companies have developed an adversarial relationship with their customers.

I know precisely, Hello, My name is(withheld because I don't have permission to use it) I am the attorney representing Michael Payne in reference to Claim # and I would like to clear this claim up with out undue litigation. This is what I was told.

Michael, not sure of the conflict of interest problem but companies will often offer to sell back things like that. It will save them the trouble of having to sell it at auction. Might look into it.
The first guitar that UPS broke for me, they wanted it. I informed them that nobody was going to be playing that guitar with my name on it. I said that I'd be happy to give them the guitar but I'd be cutting it in half. (they agreed to let me keep it).
The second guitar that UPS broke for me, they let me buy back for something like $300.
The guitar that FedEX broke for me, Heritage took care of and let me buy it back. Pretty cheap but I don't remember the figure.
If they insist on taking the guitar, put it in a box with absolutely not packing and let their monkeys have at it.

Michael,

    Congratulations! FedEx did the right thing by you and I'm glad to hear it. I
had written them a letter the day following your post stating that they had
denied your claim.

     I haven't received any reply and don't expect to, but I was sure to explain
how the guitar building and buying public is well connected and woven
tightly together by the internet and quickly communicate these kinds of
occurrances in an effort to help and protect one another.

It's just corporate reasoning behind keeping the guitar. My dad was an
engineer and law professor at different points in his life.   He would clear
things up for my sister and I all the time. What they're basically asking
the person on the other end is, "Is this really worth your energy?" The
only one that ever played him out was a health insurance company that
didn't want to cover a surgery for my sis. They usually don't want to play
the hand because truth be told, it's not worth it.   That doesn't make the
news any less desirable!
